What is an adjustment of status?

An adjustment of status is a legal process that allows an individual who is in the United States to apply for permanent residence without having to return to their country of origin. This process is available to certain immigrants who have fulfilled certain requirements related to their immigration status. In Virginia, for example, an adjustment of status is available to individuals who have entered the U.S. with a valid visa, have maintained their legal status, and have valid employment authorization. The adjustment of status can be requested to change the immigrant’s current nonimmigrant visa status to a lawful permanent resident status. This process is commonly referred to as a “green card” application.
