What is the H-2B visa?
The H-2B visa is a visa program that allows employers in Texas to hire foreign workers, primarily in seasonal or temporary positions, when they are unable to find U.S. workers for the job. The H-2B visa program is a limited program that is regulated by both the United States and the Texas Department of Labor. In order to qualify for the H-2B visa, the employer must demonstrate that there are no U.S. workers available to perform the work, and the job must be seasonal or temporary in nature. The employer must also prove that the hiring of foreign workers will not negatively affect the wages and working conditions of similarly employed U.S. workers or the employment opportunities of U.S. workers. The H-2B visa is valid for a period of up to one year, and can be renewed on a yearly basis. The visa also allows the foreign worker to travel in and out of the United States during their period of stay. In order to receive the visa, the employer must pay application and recruitment fees, pay the foreign workers wages that are greater than or equal to the prevailing wage for the occupation, and provide certain benefits such as vacation and medical insurance. The H-2B Visa program is an employer-sponsored program that allows employers in Texas to fill temporary labor needs with workers from outside the U.S. It can be a useful tool for employers who might otherwise have difficulty finding qualified workers for the job.
