What is a national interest waiver?
A national interest waiver is a type of waiver available under U.S. immigration law that allows certain foreign nationals to request an exception to the usual requirements of a particular visa or work permit. This waiver is based on the foreign national’s ability to serve the U.S. national interest, meaning that the foreign national must show that his or her presence in the United States is of greater importance to the U.S. than if the foreign national had to go through the usual immigration process. In Washington, if a foreign national can demonstrate that their presence in the country would serve the U.S. national interest, they may be eligible for a national interest waiver. In addition to proving their value to the U.S., foreign nationals must meet other criteria to qualify for a waiver, such as having certain qualifications and knowledge that are not available among U.S. citizens. In some cases, those who are not eligible for other types of work permits may also be eligible for a national interest waiver. With a national interest waiver, a foreign national in Washington can be authorized to work and live in the United States without having to go through the usual immigration process.
