What is a labor certification?
A labor certification is a document that is used to confirm that an employee in Washington is legally authorized to work in the United States. In order to obtain a labor certification, an employer must provide proof that they have conducted a rigorous recruitment process and that there are no qualified U.S. workers available to fill the position. The labor certification process is managed by the U.S. Department of Labor and is a necessary step in obtaining an employment-based immigrant visa. The employer must file the labor certification application with the U.S. Department of Labor, and if it is approved, then they can proceed to file an immigrant visa application with U.S. Citizenship and Immigration Services. The labor certification is based on the fact that the hiring of a foreign worker should not adversely affect the wages and working conditions of similarly employed United States workers. The employer must demonstrate that there are no qualified and available U.S. workers and that the foreign worker will not displace any U.S. worker. Labor certifications are also a requirement for employers wishing to hire temporary foreign workers. In this case, the employer must receive an approved labor certification and then submit an H-2A petition for each individual worker to the Department of Homeland Security.
