What are the requirements for an L-1 visa?
An L-1 visa is a nonimmigrant visa that allows a company to transfer an executive or manager, or a specialized knowledge employee, to the United States. In order to qualify for an L-1 visa, both the employer and the employee must meet certain criteria. The employer must be a U.S. or foreign company that is related to the company abroad through ownership or control. The employer must also have been doing business in the U.S. for at least one year and have offices both in the U.S. and abroad. The employee must have worked for the foreign company for one year in the three years before the application is filed. They must also be coming to the U.S. to work in an executive, managerial, or specialized knowledge capacity. This means that the employee must supervise and control other employees or have expertise in a specialized field. Lastly, the employee must intend to work for the U.S. affiliate, subsidiary, or parent company. They must also hold the same position they held abroad, though they may fulfill different roles within the business while in the US. An L-1 visa also allows certain family members of the visa holder to accompany them to the U.S. as long as they meet certain criteria as well. This can include a spouse and unmarried children under the age of 21.
