What is a conditional permanent resident status?

Conditional permanent resident status is a type of immigration status granted to certain foreign nationals who are married to a United States citizen or permanent resident. This type of status is valid for two years, after which the foreign national must file a petition with the United States Citizenship and Immigration Services (USCIS) to have their status adjusted. In Massachusetts, foreign nationals granted this status are eligible to apply for an unrestricted driver’s license, open a bank account, and legally work or study in the United States. For the foreign national to retain permanent residency, the petition must be filed 90 days before the expiration of the two-year conditional permanent resident status. If the petition is not filed, the foreign national will be deported. To be eligible for this status, the foreign national must prove that their marriage to the U.S. citizen or permanent resident is authentic, not entered into to gain permanent residence in the United States.
