What is a U visa?

A U visa is a special type of visa provided by United States Citizenship and Immigration Services (USCIS) for victims of certain criminal activities. It is designed to assist victims of crimes, as well as their immediate family members, to remain in the United States and to assist law enforcement in the investigation and/or prosecution of the crime. In Tennessee, U visas are available to immigrants who have been victims of certain qualifying criminal activities, including domestic violence, sexual assault, trafficking, and other serious crimes. Applicants must demonstrate that they have suffered substantial physical or mental abuse due to the criminal activity, and must possess information about the criminal activity. In addition, the applicant must have been helpful to law enforcement in the investigation or prosecution of the crime in order for the visa to be obtained. The U visa also provides certain benefits to qualified applicants, including work authorization and protection from deportation. While the visa is only valid for four years, applicants may be able to apply for permanent residence after three years.
