What is the process for a fiancé(e) to become a US citizen?
In California, a fiancé(e) of a United States citizen can enter the country on a K-1 visa. This is the first step in the process to become a United States citizen. The K-1 visa is a non-immigrant visa, meaning the holder is not an immigrant and can only remain in the United States for a period of time. In order to get the K-1 visa, the U.S. citizen must submit a petition to the United States Citizenship and Immigration Services (USCIS). This petition must include proof that both people are eligible to marry and evidence of a valid relationship. Once the petition is approved, the fiancé(e) can then apply for a K-1 visa at a U.S. Embassy or Consulate. To become a United States citizen, the fiancé(e) must stay in the United States for at least 90 days after the K-1 visa is issued. During that time, they must marry the U.S. citizen who filed the petition. After the marriage, the couple must file an application for permanent residence with USCIS. Once the application is approved, and after one year of physical presence in the United States, the fiancé(e) may apply for a green card, or permanent residence. After three years of physical presence as a permanent resident, they may then apply for United States citizenship. In California, the fiancé(e) of a United States citizen may become a United States citizen through the K-1 visa process, marriage, and application. Each step of the process must be completed in order to obtain citizenship.
