How can a party obtain a stay of execution in international litigation?

A stay of execution is an order from a judge that stops a court judgment from being enforced. In international litigation, a stay of execution can be granted if the court finds that compelling reasons exist to delay the enforcement of the judgment. The party seeking the stay must file a motion with the court. Generally, the court will consider the following factors when deciding whether to grant the stay: the likelihood that the party seeking the stay will succeed on the merits of their case, such as whether or not they have provided compelling evidence; the likelihood that the party will suffer irreparable harm if the stay is not granted; and the potential harm to the opposing party if the stay is granted. The court may also take into account any special circumstances related to the case. In Florida, the court may grant a stay of execution when the defendant is a resident of another country and there are proceedings pending before a court outside of the United States. The court can also grant a stay of execution when it finds that the execution of the judgment would be contrary to the public policy of the state. The court can also consider other factors such as the extent to which parties have complied with court orders, whether or not the case has been dismissed, and the amount of time that has passed since the judgment was entered. The court may also consider any other factors it deems relevant in deciding whether or not to grant a stay of execution. If the court decides to grant the stay, it will set the terms and conditions of the stay, such as the length of the stay and the amount of security that must be posted by the party seeking the stay.
