What is the process for applying for VAWA protection?

The process for applying for VAWA (Violence Against Women Act) protection in California varies, depending on the specifics of each individual’s case. Generally, the process begins with filing an I-360 petition with U.S. Citizenship and Immigration Services (USCIS). This petition must be accompanied by evidence documenting the two-fold requirement that proves the applicant is a victim of battery or extreme cruelty inflicted by a qualifying family member, and that the applicant is a U.S. citizen, lawful permanent resident, or certain other non-citizens. The receiving office will examine the initial evidence and may require more evidence before making a decision on the petition. If the petition is granted, the applicant will be able to apply for various forms of immigration relief. This could include a U-Visa, employment authorization, lawful permanent residence, or deferred action. The applicant will need to file the necessary application or applications and submit any additional evidence that is requested by USCIS. All of the applications and evidence must be filed with the correct forms and fees. In some cases, the applicant may be eligible for a “Self-Petition” which would allow them to bypass the original I-360 filing stage. Self-petitions can only be filed if the applicant can prove that they are facing extreme hardship. Again, the applications must be the correct forms and accompanied by the necessary evidence and fees. Finally, once all the paperwork is in order and the application is approved, the applicant will receive a final decision from USCIS. At that point, they will be able to apply for certain immigration benefits, such as being allowed to receive a green card, a U-Visa, or other forms of relief.
