What is the Advance Parole program?

The Advance Parole program is an immigration law program that allows certain individuals in Virginia to travel outside the United States and re-apply for admission without abandoning their current immigration status. It is a discretionary document that provides permission for an individual to re-enter the country after a temporary absence. Advance parole can be granted to applicants in three situations: if you are a green card holder, if you have a pending application for adjustment of status, or if you have a pending application for asylum. If you are granted advance parole, you must present the document to the U.S. Customs and Border Protection upon your return to the United States. Advance parole does not guarantee that a person will be admitted back into the United States. It only grants the permission to apply for re-entry after returning from a temporary absence. Re-entry will still be subject to U.S. immigration laws and the discretion of the Customs and Border Protection officer at the point of entry. In Virginia, if the Advance Parole is not used within one year or the underlying application is denied or withdrawn, the parole document will be cancelled. Therefore, it is important to make sure all other immigration applications are in order before applying for advance parole.
