What is a family-based petition?

A family-based petition is a type of immigration petition created to allow a foreign national to come to the United States to live with his or her family. It is commonly used by spouses, children, and parents of U.S. citizens and permanent residents. It is also for immediate relatives of U.S. citizens, such as widow(er)s, siblings, and stepchildren. To begin the process of a family-based petition in Indiana, the applicant must have a family member (preferably a U.S. citizen) who is willing to act as the petitioner. The petitioner must submit the appropriate petition (either a Form I-130 or Form I-360) in order to begin the process. The petitioner will also need to provide evidence of the relationship to the applicant, such as an original birth certificate or marriage certificate. The applicant is also required to provide documents such as a birth certificate, passport, and proof of relationship in order to successfully move forward with the petition. The applicant also must undergo a medical exam and have a visa interview at the U.S. Embassy or consulate in their home country. Once the petition has been approved, the applicant will receive an immigrant visa in the mail or will be able to apply for an adjustment of status if they are already living in the United States. Family-based petitions provide an opportunity for families to reunite in the United States. The process for obtaining a family-based petition in Indiana can be lengthy and complex, but with the help of an experienced immigration attorney the process can be simplified and you can be on your way to reuniting with your loved ones.
