What is the refugee/asylee process?
The refugee/asylee process in Indiana is the procedure by which individuals who have been persecuted or fear persecution in their home countries can seek refuge in the United States. Refugees and asylees, although often used interchangeably, are two separate categories of immigrants. Refugees are people who have fled their home country and are seeking protection elsewhere due to a well-founded fear of persecution on account of their race, religion, nationality, political opinion, or membership in a particular social group. To receive refugee status, refugees must meet the requirements established by the Refugee Act of 1980, and must be approved through an extensive screening and interview process. Asylees are similar to refugees in that they are fleeing persecution; the difference is that asylees are already physically present in the US, either with valid or expired visas. To be eligible for asylum, asylees must demonstrate that they suffered persecution in their home country on account of one of the five protected grounds listed above. All refugee/asylee applicants must submit an application with USCIS, the United States Citizenship and Immigration Services. The application will then be screened by USCIS to determine if the individual is eligible for refugee or asylee status. If the individual is found to be eligible, they will be referred to the Refugee and Asylee Resettlement Program where they can receive additional assistance and resources to begin their lives in Indiana.
