How do I obtain a labor certification?
In order to obtain a labor certification in North Carolina, you must be sponsored by an employer who is seeking to fill a position in the state. Your employer must first show that there are no qualified U.S. workers who can perform the job they are offering to you. They must also demonstrate that you are qualified to fill the position. In order to receive a labor certification, your employer must submit a form called an Application for Permanent Employment Certification to the Department of Labor (DOL). The application must include documents such as job descriptions, proof of job requirements, a statement of the employer’s intent to hire you, and evidence of the employer’s recruitment efforts. The DOL will then review the application and determine whether or not the job requirements are legitimate. If the job requirements are legitimate, there must be an open and available position, and the employer must prove that they have taken reasonable steps to recruit for the position. If the DOL finds that these criteria have been met and that there are no qualified U.S. workers to fill the position, a labor certification will be issued. Once the labor certification has been issued, the employer can then file a petition with the United States Citizenship and Immigration Services (USCIS) to obtain a green card. Once the petition is approved, you can then apply for permanent residence in the United States.
