What is the National Labor Relations Act?

The National Labor Relations Act (NLRA) is a federal law that protects the rights of workers to form, join, and help labor unions, and prohibits employers from engaging in unfair labor practices. The NLRA was enacted in 1935 and is enforced by the National Labor Relations Board (NLRB). Under the NLRA, workers have the right to form or join labor unions and to bargain collectively with their employers on wages, hours, and other terms and conditions of employment. Employers are prohibited from interfering with, restraining, or coercing employees in the exercise of their rights. Employers are also prohibited from discriminating against workers on the basis of their union activities or beliefs. The NLRA provides that employers and unions must bargain in good faith. This means they must both make a serious effort to reach a mutually agreeable outcome. When employers and unions are unable to reach an agreement, they can engage in a process of mediation and arbitration to resolve the dispute. The NLRA also includes rules that govern the conduct of union elections. These rules require that employers provide employees with information about the election and allow them to cast secret ballots in deciding whether or not to join a union. The NLRA has helped to ensure that workers in Maryland and across the country are able to exercise their right to organize and bargain collectively with their employers.
