What is anancillaryadministration?
Anancillaryadministration is a form of estate administration in Florida that is used when a deceased person had properties in multiple states. It is triggered when the main administration takes place in another state, while some of the assets of the deceased person are located in Florida. Anancillary administration is necessary in order to ensure that the assets located in Florida are appropriately distributed. In Florida, the ancillary administration process involves filing a petition in the probate court in the county where any of the assets are located. This petition must include an authenticated copy of the death certificate, as well as the order of administration from the court in the state where the main administration took place. The petition must include a description of all the Florida assets, as well as the estimated value of each asset. Once the petition is approved by the Florida court, the ancillary administrator will have the same authority as the administrator of the main estate. This includes the right to manage, possess, and distribute the assets located in Florida. The ancillary administrator also has the responsibility of filing an inventory and keeping accurate records, as well as preparing a final accounting of the assets and filing it with the court.
