What is the International Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families (CMW)?
The International Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families (CMW) is an international treaty adopted by the United Nations General Assembly in 1990. It is designed to protect the rights of migrant workers and their families. This convention applies to all migrant workers and members of their families, regardless of their status (legal, illegal, documented, or undocumented). The convention provides legal protection of human rights of migrant workers and their families and safeguards the rights of migrant workers to equal protection of the law and to be free from discrimination. It also prohibits slavery, servitude, or practices similar to slavery and outlines the right to an effective remedy and the right to access the judicial system. Furthermore, the CMW outlines the rights of migrant workers in regards to labor standards, labor recruitment, the right to form and join trade unions, and the right to access social benefits and services, including education and health care. In addition, the CMW outlines the protection of the right to family reunification and outlines the rights of children of migrant workers. In North Carolina, the CMW has been endorsed by the state government and is referenced in the "North Carolina Freedom of Information Act" and the "North Carolina Human Trafficking Laws". The CMW has also been used as a model to develop new protections and regulations for migrant workers at the state level.
