The International Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families, also known as the CMW, is an international law that provides legal protections for migrant workers and their families. It was adopted by the United Nations General Assembly in 1990 and entered into force in 2003. The CMW is the only legally binding international instrument specifically devoted to the protection of the rights of migrant workers and their families. The CMW generally protects the rights of migrant workers, such as their freedom of association, the right to just and favorable conditions of work, and the freedom to move and take up residence in the country of employment. It also protects the rights of the family members of migrant workers, including the rights to family unity, the right to education, and social security. In South Dakota, there are a few organizations dedicated to protecting the rights of migrant workers and helping them access the protections provided by the CMW. For example, the South Dakota Migrant Worker Project provides legal assistance to migrant workers, and the National Farm Worker Ministry works to protect the rights of migrant farm workers. Both organizations advocate for the implementation of the CMW in South Dakota.
