What is the International Convention on the Rights of Persons with Disabilities (CRPD)?

The International Convention on the Rights of Persons with Disabilities (CRPD) is an international treaty that was adopted by the United Nations (UN) General Assembly in 2006. The CRPD is the first legally binding international instrument which sets out the rights of people with disabilities and aims to ensure their full and equal participation in society. South Carolina is one of 159 countries that have ratified the CRPD. The Convention is based on the principles of respect for inherent dignity, individual autonomy, non-discrimination, participation and inclusion in the societies. It guarantees equal rights and protection to people with disabilities in areas such as access to education, employment, health, political participation, and justice. The CRPD has four main elements: (1) The General Provisions articulating the purpose and nature of the Convention and the general principles that should guide its implementation; (2) The Rights of Persons with Disabilities which outlines the specific rights and freedoms that should be provided; (3) The Obligations of States Parties which covers the duties of the states in implementing the Convention; and (4) The Monitoring and Reporting Framework which outlines the necessary strategies to monitor and report the implementation of the Convention. South Carolina has an obligation to implement the CRPD by enacting the necessary laws, setting up independent monitoring mechanisms, and effectively enforcing the Convention. This will ensure that all citizens in South Carolina are able to enjoy their rights and participate fully in society.
