What is the International Law of Humanitarian Intervention?
The international law of humanitarian intervention is a set of guidelines that governs the use of military forces in response to humanitarian crises. This includes cases where a state is unable or unwilling to protect its citizens from violence, suffering, or abuse. Generally speaking, the principle of humanitarian intervention states that a state may use force to protect human rights violations in another state even in the absence of formal authorization by the international community. In South Dakota, the state has followed the U.S. stance on humanitarian intervention. This means that the state would have to get approval from the U.S. federal government and the United Nations before taking any action in a given situation. As a result, South Dakota has not taken any direct action in response to any international humanitarian crisis. However, the state is a signatory of the Convention on Humanitarian Intervention and Other Related Matters and is obligated to abide by the terms of the treaty. This convention states that all signatories must take action to protect the victims of human rights violations, which includes the right to use force if necessary. Though South Dakota has not taken action in the past, the state could serve as a model for other nations in the region by demonstrating respect for international law.
