What is the International Convention for the Protection of All Persons from Enforced Disappearance (CPED)?

The International Convention for the Protection of All Persons from Enforced Disappearance (CPED) is an international treaty adopted in 2006 by the United Nations General Assembly. It is the first legally binding international instrument that specifically criminalizes enforced disappearance, and holds governments accountable for the use of this practice. It defines “enforced disappearance” as the deprivation of liberty by agents of the state or by persons or groups acting with state consent, and the refusal to acknowledge the deprivation or to give information on the whereabouts of the disappeared person. CPED provides certain safeguards against the risk of enforced disappearances, such as the right to humane treatment for those at risk, the right to a prompt and effective investigation into any alleged enforced disappearances, and the right to not be tried or punished twice for the same offense. Additionally, CPED establishes certain obligations for all states that have signed the treaty, such as the obligation to take measures to prevent and criminalize enforced disappearances and ensure that all persons are protected from this crime. CPED has been adopted by many countries, including the United States. However, Maryland has yet to sign on to the Convention. The State of Maryland should consider ratifying CPED, as it would help to protect all persons from enforced disappearances, both inside and outside of Maryland. Ratifying CPED would also show Maryland’s commitment to protecting human rights and supporting international law.
