What is the Rome Statute of the International Criminal Court (ICC)?
The Rome Statute of the International Criminal Court (ICC) is an international agreement that was adopted on July 17th, 1998, and entered into force on July 1st, 2002. The ICC is an independent court of justice that is based in The Hague, Netherlands, and has jurisdiction over individuals accused of committing international crimes such as genocide, war crimes, and crimes against humanity. The Rome Statute is the foundation of the ICC and establishes the Court’s principles, functions, and procedures. Specifically, the Statute outlines the criminal offenses that are subject to ICC criminal proceedings and prescribes the measures of criminal responsibility and procedures for trial. Additionally, the Statute determines the Court’s jurisdiction, the role of states in relation to the Court, the powers of the Court’s organs, as well as the powers of the Prosecutor. The Rome Statute applies to all states that have ratified it, including Georgia, which became a member of the ICC in 2003. The ICC in Georgia works to investigate and prosecute serious international crimes committed within the territory of Georgia or by Georgian citizens onwards another party’s territory since then. As part of the ICC, Georgia is obligated to cooperate with the Court and implement the Statute’s provisions.
