What is the Law of the Sea Tribunal (ITLOS)?

The Law of the Sea Tribunal, also known as the International Tribunal for the Law of the Sea (ITLOS), is an international court established by the United Nations Convention on the Law of the Sea (UNCLOS) of 1982. The tribunal has the authority to settle disputes between parties to the UNCLOS and to provide advisory opinions on legal questions related to the Convention. The tribunal is composed of 21 judges who are elected by states parties to the Convention and are independent of any government or international organization. The tribunal’s headquarters is located in Hamburg, Germany, but it can also convene at other locations for special circumstances. The tribunal has the power to settle disputes regarding the interpretation and application of the UNCLOS related to issues such as maritime delimitation, navigation rights, exploitation of marine resources, protection of the marine environment, and scientific research activities. The tribunal can also address disputes concerning fisheries, marine scientific research, and protection of the marine environment. The decisions issued by the tribunal are binding on the parties to the case and are considered an authoritative interpretation of the UNCLOS. The tribunal can also issue advisory opinions on questions of international law referred by any UN or Organization for Security and Co-operation in Europe (OSCE) organ, organization, or other such entity. The ITLOS provides an important mechanism of peaceful dispute resolution and its decisions are instrumental in providing governments with legal advice and guidance in their maritime disputes. As such, it is an important tool for preserving peace and stability in New Mexico and in the world.
