The International Convention on the Prohibition of the Use, Stockpiling, Production and Transfer of Anti-personnel Mines and on Their Destruction (APMBC) is an international law treaty signed by over 150 countries that works to ensure the elimination of anti-personnel landmines. Anti-personnel landmines are explosives buried in the ground or placed above ground that are designed to explode when disturbed by people or animals. The APMBC requires signatory states to destroy all anti-personnel landmines in their possession and never to produce or acquire more. It also requires them to develop and promote their own domestic laws to enforce the treaty’s provisions. In addition, the treaty requires signatories to remove or turn over anti-personnel landmines in territories it occupies to the control of the legitimate government. In South Dakota, the APMBC treaty is codified into law in the state legislature. It is illegal for any person or organization in the state to produce, possess, or transfer anti-personnel landmines. It is also illegal for anyone to use anti-personnel landmines in any part of the state without prior authorization from the government. Violation of this law can result in serious penalties, including steep fines and jail time.
