How long does it take to obtain a patent?
In Rhode Island, it usually takes about 12-18 months to obtain a patent from the United States Patent and Trademark Office (USPTO). This process begins when the patent application is filed. The USPTO then reviews the application to determine if it meets the requirements of patentability. Once the application is accepted, the USPTO will issue a “Notice of Allowance,” which establishes the patent as a formal legal protection. The USPTO will then examine the application in-depth to determine if it is valid and in conformance with all the requirements for patentability. This examination process can take approximately 6-12 months. During the examination process, the USPTO may request additional information and may require changes to the application in order to make it patentable. Once the patent is granted, the goal is to maintain the patent for its full term, which is 20 years from the date of filing the original application. In order to maintain the patent, the patent holder must pay maintenance fees every 3.5, 7.5 and 11.5 years after grant. If higher-quality application and examination techniques are employed, the patent process may be completed in about 6 months. However, it can take up to 18 months, so it is best to plan for the longer timeframe to ensure that the patent is properly protected.
