How do state laws of intestacy apply to adopted children?

In Minnesota, adopted children are subject to the same laws of intestacy as biological children. Intestate succession is the process by which assets are distributed in the event someone passes away without creating a will. If a decedent in Minnesota passes away without a will, their assets will be divided according to the laws of intestacy. Minnesota law allows adopted children to receive the same share of an intestate estate as biological children. In order for the adopted child to receive their share of the estate, the law requires that the adoption must have been finalized before the decedent’s death. The adoption must have existed for at least one year in order for the adopted child to qualify as an heir. Adopted children who are adopted by their stepparent or another adoptive parent are not able to inherit from the decedent’s estate. In conclusion, adopted children in Minnesota are treated the same as biological children under the laws of intestacy. This means that, in the event of an intestate succession, the adopted child is entitled to receive their fair share of the estate. However, the adoption must have been finalized prior to the decedent’s death and must have existed for at least one year. Adopted children who are adopted by their stepparent or another adoptive parent are not entitled to receive a share of the intestate estate.
