What is the procedure for appealing a juvenile court decision?
In Texas, the process for appealing a juvenile court decision involves a few steps. First, the appellant, or the person who is appealing the decision, must file a notice of appeal with the court clerk within 10 days of the court’s ruling. The notice of appeal should include the date the court issued its decision and the date that the appellant intends to file the appeal. Then, the appellant must file an appellate brief with the court clerk within 30 days of filing the notice of appeal. This brief should include the reasons why the appellant believes the court’s ruling was incorrect. After this, the response brief must be prepared by the respondent, or the party opposing the appeal, within 30 days. The response brief should explain why the court’s ruling should stand. Once the response brief is filed, a court of appeals will then hear the case. During the hearing, both sides will present their arguments and the court of appeals will consider the briefs as well as the arguments made in court. The court of appeals may then affirm the juvenile court decision, reverse it, or order a new trial. Once the court of appeals has reached its decision, either party can then appeal the decision to the Supreme Court of Texas. The appellant must file a petition for review within 10 days of the court of appeals’ decision. After the petition for review is filed, the Supreme Court of Texas may grant the petition and hear the case or decline to hear it.
