What is the process for appealing a juvenile court decision?
If a parent or guardian disagrees with the decision of a juvenile court in New York, they have the right to appeal the decision. The process for appealing a juvenile court decision differs depending on the court’s jurisdiction, which includes county, family, and supreme courts. The appeals process begins with a notice of appeal, which must be filed within 30 days of the decision. The notice of appeal must be filed with the court in which the case was originally heard, as well as the court to which the appeal is being made. The court may or may not also require an affidavit explaining the grounds for appeal. Once the notice of appeal has been filed, the details of the case will be presented to the higher court. During the appeals process, the appellate court will review the evidence that was presented in the lower court. The appellate court will assess the lower court’s decision to determine if it was legally sufficient. If the appellate court determines that the lower court’s decision was not legally sufficient, the court may remand the case back to the lower court for reconsideration or for further proceedings. Once all the evidence has been reviewed, the appellate court will issue a written decision. If the decision is in favor of the appellant, the appellate court will reverse the lower court’s decision and order a new trial, or order any other remedies that it determines to be appropriate. If the decision of the appellate court is not in favor of the appellant, then the decision of the lower court will stand. In this situation, the appellant may file a motion for reconsideration, ask for a rehearing, or take the case to the Court of Appeals.
