What are the laws concerning wage and hour disputes?

In Florida, wage and hour disputes are governed by the Fair Labor Standards Act (FLSA) and Florida’s Minimum Wage Act (MWA). The FLSA is a federal law that sets the minimum wage and overtime requirements for most employees. It establishes the minimum wage rate, overtime pay rate, and record keeping requirements pertaining to wages and hours. The MWA is a Florida state law that sets the minimum wage rate for some employees. Under the FLSA, employers must pay employees at least the federal minimum wage for all hours worked, and overtime pay for any time over 40 hours worked in a work week. All employees that are nonexempt from the FLSA must be paid overtime wages at a rate of one and one-half times their regular rate of pay. The state of Florida also requires minimum wage rates for certain employees. The rate is currently $8.56 for employees that qualify under the state regulations. Employees are allowed to file wage and hour disputes with the U.S. Department of Labor or the Florida Department of Economic Opportunity. Complaints are investigated to determine if any violations have occurred. If a violation is found, the employer may be responsible for paying any unpaid wages, plus an additional amount as a penalty. Additionally, employers may be required to pay attorneys’ fees and costs for employees if a violation is proven.
