What is the Migrant and Seasonal Agricultural Worker Protection Act?

The Migrant and Seasonal Agricultural Worker Protection Act (MSPA) is a federal labor law that applies to agricultural employers, farm labor contractors, and agricultural associations in the state of Utah. This law is designed to protect the rights of migrant and seasonal agricultural workers who are employed in the state of Utah. Under the MSPA, employers are required to provide agricultural workers with wages, benefits, and working conditions that comply with the act. Employers must also provide migrant and seasonal agricultural workers with information about their job duties, accommodations, pay, and benefits. Employers must provide employees with written contracts that outline the wages, benefits, and working conditions they will receive. The MSPA also provides agricultural workers with certain rights such as the right to inspect working conditions, the right to file and participate in complaints and hearings with the Department of Labor, the right to file civil suits for damages, and the right to form and join labor organizations. The MSPA is enforced by both the Department of Labor and state labor agencies. These agencies have the authority to investigate violations and impose penalties on employers who violate this law. If employers are found to be in violation of the MSPA, they may be subject to civil money penalties and/or criminal prosecution. The MSPA also provides for the recovery of unpaid wages and other benefits for affected workers.
