How do same-sex marriages work under the law?
In Indiana, same-sex marriages are legal and work the same way as any other marriage under the law. Same-sex couples must meet all the same legal requirements as any other couple in order to get married. This includes having an Indiana marriage license and filing it with the county court clerk. Same-sex couples will also have to meet all the same minimum age and residency requirements that any other couples have. This means that same-sex couples must be 18 years of age or older, and be residents of Indiana. They will also have to have a valid government issued photo ID in order to obtain a marriage license. Once the marriage license has been legally obtained, same-sex couples will be required to have a ceremony witnessed by at least two people in order for the marriage to be valid. This could be a civil or religious ceremony. Same-sex couples are also able to get married through a court or commissioner or self-uniting marriage. After the wedding, the couple must have their marriage license signed and returned to the county court clerk. Once the marriage license has been legally returned and filed, the marriage will be considered legal and binding in Indiana and all the same laws that apply to any other marriage will apply to the same-sex marriage. This includes laws regarding taxes, adoption, inheritance, and more. Same-sex couples are also eligible to receive the same marital benefits as any other couple.
