What are the grounds for an annulment?

In Texas, an annulment is a type of legal proceeding to end a marriage. The grounds for an annulment are different than those for a divorce. Annulment voids the marriage, making it as if it never existed. In order to obtain an annulment in Texas, a court must decide that at least one of the following conditions applies to the marriage: either spouse was under the age of 18 when the marriage occurred; either spouse was already married; either spouse could not legally give consent because of mental incapacity or intoxication; the marriage was forced or obtained by fraud or duress; or either spouse did not have the mental capacity to consent to marriage due to mental illness or mental disability.
