Yes, medical marijuana products are subject to taxation in Virginia. According to the Virginia Department of Taxation, "all marijuana and marijuana products acquired for medical use are subject to the applicable local and state taxes, including the 6.0% state sales and use tax, the 4.3% state motor fuels sales and use tax, and other applicable local taxes." The Department of Taxation also states that all medical marijuana products purchased for medical use must have a valid medical marijuana certificate from the state in order for the product to be exempt from taxation. In addition, when medical marijuana products are purchased with a valid medical marijuana certificate, the purchaser must present the certificate to the local retailer to ensure that the applicable taxes are not charged.
