No, medical marijuana prescriptions are not valid in other states. Each individual state has its own laws regulating the medicinal use of marijuana. Virginia has medical marijuana laws that allow for the use of marijuana only for medicinal purposes as approved by a licensed healthcare provider. Therefore, a prescription that is valid in Virginia may not be accepted in another state because that other state may not recognize the Virginia laws. In order for a medical marijuana prescription to be valid in a different state, the patient would need to receive a prescription from a licensed healthcare provider in that state, as well as comply with the laws of the other state. That being said, 33 states, as well as Washington D.C., currently have laws that protect patients who lawfully use medical marijuana from criminal prosecution. Depending on the state, they may require a medical marijuana patient to register with the state’s specific medical marijuana program. Additionally, as of 2020, 16 states now recognize medical marijuana from other states, providing additional access for those who need it. In summary, medical marijuana prescriptions are not valid in other states unless the other state specifically recognizes it. States that do recognize out-of-state medical marijuana may require a patient to register with their program, as well as comply with all applicable laws.
