What is the Military Rules of Evidence (MRE) 608?

The Military Rules of Evidence (MRE) 608 is an important part of military law in New York State. It is a rule that sets requirements for the use of evidence at a court-martial. This rule provides an essential protection against the introduction of evidence that is unreliable or prejudicial. MRE 608 states that character evidence of a witness may be allowed for the purpose of showing that their testimony may be affected by their character for truthfulness. This means that the court-martial will consider the witness’ reputation for truthfulness and trustworthiness when determining if they should be believed. Evidence such as a witness’ prior statements, or prior criminal convictions, may be used to support an argument by either party. MRE 608 also allows for the use of corroborating evidence when a witness’ testimony is in dispute. This evidence can be used to either support or cast doubt on the witness’ statement. For example, if a witness makes a statement that is contradicted by other witnesses, the court-martial may allow for the introduction of evidence such as audio recordings of the witnesses’ conversations in order to determine the validity of the statement. Finally, MRE 608 requires that if the prosecution offers evidence of a person’s character in order to show that their testimony is not credible, then the defense must be allowed to introduce evidence of the same type in order to counter the effect of the prosecution’s evidence. This ensures a fair trial and allows both sides a chance to present their arguments. Overall, MRE 608 is a very important part of military law in New York State. It helps ensure that reliability and fairness are maintained during a court-martial by setting out specific rules for the introduction and use of evidence.
