What is an Article 107 offense?
An Article 107 offense is a violation under the Uniform Code of Military Justice (UCMJ). Article 107 of the UCMJ is a federal law that applies to active duty military personnel and reservists in the state of Tennessee. Article 107 outlines a wide range of actions that can be considered offenses, including making false official statements, making false claims, and making false statements to a superior. Each offense outlined in Article 107 carries different penalties, depending on the severity of the offense. Generally, an Article 107 offense is punishable by court-martial, loss of rank or pay, imprisonment, or a combination of the three. Article 107 also covers offenses related to military property. It prohibits personnel from damaging, destroying, or taking government property or the property of another person, without lawful authority. Any of these actions can be considered a criminal offense under Article 107. Offenders may face penalties such as imprisonment, loss of rank or pay, and a court-martial. In addition, Article 107 covers offenses related to the mistreatment of prisoners, such as cruelty, maltreatment, or neglect. These offenses can be extremely serious and may require court-martial proceedings. If an individual is convicted of a mistreatment offense under Article 107, punishment could include a dishonorable discharge from the military, loss of rank or pay, and imprisonment.
