What does maritime law cover?
Maritime law, or admiralty law, is the body of laws that governs activities that occur on the water. In West Virginia, it applies to both navigable waters and the activities that take place on them. This includes inland waterways, large lakes, and coastal areas. Maritime law covers a wide range of topics, including the following: vessel operations, ship safety, passenger rights, and jurisdiction over water-based businesses. It also covers maritime contracts, insurance, and salvage rights. Within these areas, maritime law addresses issues such as who is responsible for any damage caused by vessels, how vessel operators must use their vessels, and the rights of passengers. Maritime law also governs the transport of goods and personnel across water, as well as the utilization of water resources, such as fishing, oil and gas exploration, and port operations. It regulates how captains and crew members are hired and compensated, and how vessel owners are liable for damage caused by vessels. As well, maritime law sets forth the obligations, rights, and liabilities between passengers and vessel operators. Finally, maritime law governs the legal recourse available to anyone who is injured, suffers loss, or seeks compensation for maritime-related accidents or incidents. These cases are taken to court through civil litigation, where the injured parties may seek damages or personal injury compensation.
