What is the difference between maritime law and admiralty law?
Maritime law and admiralty law are two separate but related legal concepts. Maritime law is a broad term that encompasses laws related to the marine environment, including laws governing shipping, navigation, fishing, and environmental protection on the seas. Admiralty law, also called "law of the sea," is a specific branch of maritime law that applies specifically to commercial activities at sea, such as shipping and navigation. This includes the regulation of the rights and duties of the captains, crew, and passengers of vessels, and the enforcement of maritime contracts and other maritime laws. Admiralty law also covers the rules of liability and remedies for collisions, defects in ships, personal injury claims related to accidents on the water, and salvage rights and claims. In Virginia, maritime law is governed by the Virginia Code, whereas admiralty law is governed by the Federal Rules of Civil Procedure and the body of federal law known as "The Law of the United States." Finally, admiralty law is often applied to disputes that arise between parties in other countries, such as when a foreign vessel enters United States waters.
