What is the law regarding ship registration?
Ship registration is a process in which foreign ships that wish to navigate and operate in the waters of Florida must register with the state. Florida maritime law requires that such ships must be checked for seaworthiness, meaning that they must be safe and appropriate for use in navigation and other activities. The Florida Department of State verifies that the ships are fit to navigate and operate in the state waters and that all paperwork must be accurate and up to date. Foreign ships must also have certain insurance provisions in place in order to be registered in Florida. Maritime law requires that the ship must have general liability insurance to protect against any bodily injury, property damage, or loss resulting from its operations. Additional insurance may be required depending on the type of activity the ship is involved in, such as pollution, marine cargo, offshore construction, or navigation. Ship owners must also provide proof of financial responsibility such as an indemnity bond in the event of a maritime claim or a ship’s sinking or loss at sea. The bond must be in the amount of the value of the ship plus any additional costs which may be associated with its recovery or salvage. Finally, the registration documents must be signed and executed by the ship’s owner and countersigned by the Chief Financial Officer of the Department of State. The application and fees must also be submitted prior to the ship being granted registration and approval for navigation in Florida waters.
