What is the scope of the Hamburg Rules?
The Hamburg Rules are an international set of laws governing the responsibilities and rights of the parties involved in maritime transport. These rules were created by a United Nations conference in 1978 and are applicable to all contracts regarding the carriage of goods in international waters. The scope of the Hamburg Rules includes a wide range of provisions that define the responsibilities of both the carrier and the shipper. The rules lay out the obligations and corresponding rights of each party when entering into a contract for maritime transport. These include responsibilities relating to the payment of freight, liability for negligent actions by the carrier, and the loading, handling, and delivery of goods. The Hamburg Rules also provide guidance on the methods for determining the limitations of carriers’ liability. Generally, the value of goods damaged or lost is determined using the internationally recognized ‘SDR unit.’ Additionally, these rules also set out time limits for filing freight claims. In the United States, the importance of the Hamburg Rules is limited since they are superseded by the Carriage of Goods by Sea Act of 1936. Nevertheless, the Hamburg Rules are still of international importance, and they play a significant role in the laws of many other countries.
