What is the scope of the International Convention on Salvage of 1989?
The International Convention on Salvage of 1989, also called the Salvage Convention, is a treaty which provides a legal framework for the award of compensation to salvors (people or entities involved in or responsible for salvage operations) when they have risked their own resources to help protect other vessels, their cargo, and their crew in the event of a maritime incident or accident. The Convention applies to both merchant vessels and recreational vessels in California. The Salvage Convention sets out a series of rules that govern salvage operations and the awarding of rewards to salvor. It defines what is considered to be a salvageable vessel and its cargo, and describes the types of services that can be rewarded under the Convention. The Convention also details the criteria for determining the extent and amount of award for salvage operations, as well as the legal remedies available should the award be disputed. In addition, the Convention defines the rights and obligations of the salvors and those of the parties who receive their services. It also outlines the procedures for filing claims for awards, setting out the provisions for the settlement of disputes between salvor and parties receiving their services. The Salvage Convention aims to provide an equitable and effective system for the award of compensation to salvors, and to ensure that the interests of all parties are protected in the event of a maritime incident or accident.
