What is the scope of the International Convention on Oil Pollution Preparedness, Response and Cooperation?

The International Convention on Oil Pollution Preparedness, Response and Cooperation (OPRC) is an international agreement adopted in response to catastrophic oil pollution that has occurred in the past. It aims to provide better protection to the marine environment from oil pollution, facilitate the distribution of salvage operations, and provide a framework to rapidly deploy resources to contain and clean up accident areas. The convention establishes basic principles applicable to prevention, preparedness, response, and research for all marine oil pollution incidents. Under the OPRC, each signatory country is required to designate a National Authority responsible for coordinating all national oil-spill arrangements. This includes drafting national legislation covering oil pollution preparedness and response operations and meeting certain standards for dealing with oil spills. The scope of the OPRC is broad and covers a variety of measures. Signatory states must provide mutual assistance, advance notification of spills, exchange of information and research, use of equipment, and provision of technical advice and assistance in regards to preparedness and response. It also outlines procedures for conducting damage assessments in the event of a spill. The OPRC also calls for signatory states to develop strategies and plans for oil spills preparedness and response, and to establish local oil-spill response units. In New York, the scope of the OPRC is enforced through the state’s Oil Spill Fund and Pollution Cleanup Program. The fund is used to cover expenses related to prevention and response, such as equipment, training, and communications. Pollution Cleanup Program regulations ensure that polluters are held accountable for their spills. The OPRC is also utilized by the State Department of Environmental Conservation in their efforts to protect New York’s marine environment from oil spills.
