What is the scope of the Convention on Limitation of Liability for Maritime Claims?

The Convention on Limitation of Liability for Maritime Claims (CLC) is an international treaty that establishes uniform rules for the limitation of shipowner’s liability for maritime damages and claims. The CLC applies to any claim resulting from a maritime incident, including death, personal injury, property damage, and environmental damage caused by a vessel navigating in the waters of a party state or by a vessel-based activity such as fishing or dredging. Generally, shipowners are liable for damages caused by their vessels in the waters of a party state without limitation of their liability. However, under the CLC, shipowners can limit their liability to a fixed monetary amount in cases where a maritime incident results in claims that exceed that amount. The CLC was established by the International Maritime Organization (IMO) in 1976, and has since been ratified by more than 100 countries, including the United States and the Commonwealth of Virginia. The CLC provides shipowners with a predictable and equitable means of limiting their liability for damages, and thus helps protect them from potentially devastating financial losses. Additionally, the CLC sets out the procedures for resolving disputes, and governs the payment of monetary compensation to victims of maritime incidents. As such, the CLC and the associated rules and procedures are a crucial part of maritime law in Virginia and beyond.
