What is the role of the municipal judge?

The role of a municipal judge in Virginia is to preside over all legal matters that arise in a municipality. Municipal judges have the same authority as other judges in Virginia and must follow the same rules. They are responsible for making sure that all laws are followed and that justice is served. They also administer oaths, preside over preliminary hearings, issue arrest and search warrants, determine guilt or innocence of accused persons, impose sentences on those convicted, and rule on matters of evidence. Municipal court decisions may be appealed to a higher court. Municipal judges are also responsible for resolving disputes between citizens of the municipality, interpreting local ordinances, and issuing injunctions and restraining orders. In addition to hearing cases, the judge may mediate disputes and resolve problems through a process known as alternative dispute resolution (ADR). This can be more cost-effective and less time-consuming than traditional litigation. Finally, a municipal judge is responsible for maintaining civic order. The judge will issue warnings to individuals or businesses who are violating local laws; hold hearings to determine the validity of complaints; and make determinations and issue orders regarding city zoning ordinances. Municipal judges are also responsible for authorizing the establishment of certain local offices and boards, such as a board of elections.
