What is the procedure for appealing a denial of a permit or license by a municipality?

In Virginia, appealing a denial of a permit or license by a municipality requires a written notice of appeal to the circuit court located in the county or city where the permit or license was denied. This appeal must be filed within 30 days of the date of the denial. Once the written notice of appeal is filed, the court will set a date for a hearing which must take place within 30 to 60 days. At the hearing, the appellant must provide evidence of why the permit or license should have been granted. The municipality must also present evidence as to why the permit or license was denied. The court will then make a decision based on the evidence presented by both parties. If the decision is in favor of the appellant, the permit or license will be granted, and the municipality must issue it. If the decision is against the appellant, they may choose to appeal the decision again to the Supreme Court of Virginia. In some circumstances, the court may also direct the municipality to issue the permit or license despite the initial denial.
