What is the Native American Tribal Sovereignty Act?
The Native American Tribal Sovereignty Act, passed in Oregon in 2018, is an effort to recognize the rights and sovereignty of Indigenous peoples in the state. It affirms that the government of Oregon must respect tribal sovereignty, which is the right of Native American tribes to self-governance. The Act recognizes the importance of the government-to-government relationship between Oregon and tribes, and mandates that Oregon respect tribal sovereignty. The Act further recognizes tribes’ rights to manage their own affairs. This includes tribes’ ability to establish and adjudicate their own laws, regulations, ordinances, policies, and procedures; to participate in intergovernmental agreements; to negotiate and enter into contracts and other agreements; to manage economic resources; and to pursue collaborative approaches to decision-making. The Act also seeks to strengthen the relationship between Oregon and the nine federally recognized tribes located within the state. To do this, it provides a framework for communication and engagement between Oregon and Tribal governments. It also requires Oregon to consult with tribes when developing or revising laws, regulations, or policies that could affect the rights of Native American tribes. This Act represents an important step in recognizing and protecting Native American tribal sovereignty in Oregon. By affirming the government-to-government relationship between Oregon and tribes, and providing a framework for communication and engagement, the Act will help ensure that Native American tribal rights and sovereignty are respected and upheld.
