What is the tribal consultation process?
Tribal consultation is a process in which the state of California consults with federally recognized Native American tribes in order to ensure that their rights are respected and they are considered as sovereign entities when proposed laws or regulations may impact them. The process is an important part of California’s efforts to protect and preserve Native American rights, while also promoting economic development and cultural preservation. Tribal consultation begins when the state issues a notice that a proposed law or regulation may potentially impact a Native American tribe. The tribe then has an opportunity to review the proposed law and provide comment that can be considered before the law is enacted. After the consultation process is complete, the state must take into consideration the tribes’ comments and concerns when making a decision about whether or not to enact the proposed law or regulation. Although tribal consultation is a voluntary process, it has become mandatory in California due to recent legislation. The state has to consult with affected tribes at least 90 days before any new law or regulation is adopted. During this time, the tribes will have an opportunity to provide input, learn about the proposed law, and express any concerns they may have. Tribal consultation is an important step toward preserving Native American rights and ensuring that all Native American tribes in California are respected and valued. It is also beneficial for the state, as it promotes dialogue and cultural understanding with the tribes. Additionally, it allows tribes to be active participants in the process of creating laws and regulations that may affect them.
