Does parole or probation automatically terminate upon the completion of the sentence?
In Michigan, parole and probation do not automatically terminate upon the completion of the sentence. Whether a person is on parole or probation, the length of the parole or probation period is determined by the court and may be longer than the term of incarceration. Parole and probation are both forms of supervised release. Parole is a release from prison before a person has finished their sentence, while probation is a form of community supervision instead of, or in addition to, incarceration. In Michigan, parole and probation are supervised by the Michigan Department of Corrections and by the Michigan Department of Community Corrections. During parole or probation, a person is required to comply with specific conditions that must be followed during the supervision period. For example, a person on probation may be required to report regularly to a probation officer. If these conditions are not met, the parole or probation period may be extended or the person may be subject to revocation. In Michigan, when a person has completed the specified period of parole or probation, they will be discharged from parole or probation. This does not mean that the person is no longer subject to the laws of the state or that the conviction is removed from their record. It simply means that the person is released from the legal obligation of having to meet parole or probation requirements.
