What types of offenses disqualify me from parole or probation?

In South Carolina, having certain convictions or committing certain offenses can result in an individual being disqualified from parole or probation. Generally, the following offenses will disqualify an individual from parole or probation: 1. Violent offenses such as murder, armed robbery, or kidnapping; 2. Certain sexual offenses, including first-degree criminal sexual conduct; 3. Drug offenses involving the sale, manufacture or distribution of illegal drugs; 4. Habitual felon status and other repeat offenders; 5. Crimes involving a weapon, including possession of a firearm; 6. Any crime involving a domestic violence charge; and 7. Certain financial crimes, such as bank fraud or embezzlement. In addition to these offenses, being on parole or probation can also be revoked if an individual is convicted of a subsequent crime. Furthermore, individuals who are on probation may be ineligible for parole if they have not fulfilled the conditions of their probation. This could include completing required classes, obtaining a job, and making restitution payments. Finally, parole or probation may be denied if an individual has an extensive criminal history or if the judge feels that the individual is a public safety risk.
