What is the difference between parole and probation revocation?

Parole and probation revocation are two separate legal actions that can be taken by a court, or in some cases, an agency, in North Dakota. In general, probation revocation is the result of a person violating the terms of his or her probation. Probation is a chance provided by a court to an offender that allows them to remain in the community under certain conditions, as an alternative to incarceration. Parole, on the other hand, is a form of early release from prison. It is granted to an offender who has shown good behavior while in prison and meets certain criteria set by law. Parole is supervised by a parole officer and the conditions of parole are set by a parole board or parole commission. The difference between parole and probation revocation is twofold. With probation revocation, the court is revoking the person’s probation, meaning they must serve the remainder of their sentence, or a new sentence, in a correctional institution. With parole revocation, the parole board or commission is revoking parole, meaning the offender must go back to prison to serve the remainder of their sentence.
